Terms and Conditions

These terms govern your use of Gofted (gofted.com), operated by Orthentik Ltd (company number 17156606), trading as Gofted, registered in England and Wales. By creating an account or transacting on Gofted, you agree to these terms.

1. What Gofted Is

Gofted is a peer-to-peer marketplace where individual sellers list used golf equipment and buyers purchase it. Orthentik Ltd facilitates transactions but does not own, inspect, or provide any warranty on items listed. The contract of sale is between buyer and seller.

2. Eligibility

You must be 18 or over to register and transact. By registering, you confirm you are 18 or over. We may ask for verification at any time. Buyers must have a valid UK delivery address.

3. Listings

Permitted items: Used golf equipment - clubs, bags, trolleys, shoes, clothing, balls, and accessories in genuine used condition.

Prohibited items: Counterfeit or replica goods; items not owned by the seller; stolen goods; items materially misrepresented in condition; non-golf items. We remove prohibited listings without notice and may suspend the seller's account.

Seller obligations: Sellers are responsible for accurate, honest listings. This means:

Failure to disclose known defects is considered misrepresentation. Disputes arising from undisclosed defects will be decided in the buyer's favour. Gofted reserves the right to suspend or permanently ban sellers who repeatedly misrepresent items.

4. Payments, Fees, and Payouts

All payments are processed by Stripe, a PCI DSS Level 1 certified payment processor. Gofted never stores card details. See our Security page for full details.

Buyer fee: A service fee is added to the listed price at checkout. The current fee is displayed clearly on the listing page and at checkout before payment. Sellers receive the full listed price. No listing fees, no monthly charges.
Example: item listed at £100. Buyer pays £110 (+ delivery). Seller receives £100.

Buyer funds are held in escrow by Gofted until the buyer confirms receipt or the 24-hour auto-release window expires (whichever comes first). Payouts are processed daily via Stripe Connect to the seller's verified bank account, typically within 2–3 days of buyer confirmation.

Stripe's own payment processing fees apply and are separate from Gofted's service fee. These are deducted by Stripe directly.

Gofted is not responsible for delays caused by Stripe's verification or payout processes.

5. Escrow and Buyer Protection

When a purchase is made, funds are held securely by Gofted and not released to the seller until one of the following occurs:

Buyers must raise any dispute within 24 hours of delivery confirmation by contacting hello@gofted.com. Disputes raised after this window cannot be accepted and funds will have been released to the seller.

Valid grounds for dispute: Item significantly not as described; item not received; wrong item sent.

Not valid: Change of mind; minor wear consistent with the listed condition grade; buyer error (wrong size, etc.); disputes raised after the item has been used or played with.

Gofted will mediate disputes in good faith but our decision is final. We reserve the right to issue a refund or release funds based on evidence provided by both parties.

Service fee: Gofted's service fee is non-refundable once a transaction has been initiated, regardless of the outcome of any dispute or return. The service fee covers platform facilitation, payment processing, and dispute mediation - services which have been provided at the point of purchase. Where a refund of the item price is issued, this covers the item price only. Delivery costs and transit protection fees are also non-refundable once a label has been generated or the item has been dispatched.

6. Shipping and Transit Protection

Sellers are responsible for safe packaging and dispatch. Items must be packaged securely and appropriately for their size and value. Poor packaging that results in transit damage may affect the outcome of any dispute.

Gofted is not liable for items lost, damaged, or delayed in transit. Evri's standard carrier liability is capped at £25 per parcel unless transit protection has been purchased at checkout.

Transit protection: Buyers may optionally add transit protection at checkout (currently £1.99), covering loss or damage up to £300 via XCover insurance. This option is clearly presented during the checkout process. Gofted strongly recommends adding transit protection for items valued over £30. Where transit protection is not purchased, Gofted's liability for transit loss or damage is limited to Evri's standard £25 cover.

Buyers are advised to photograph items immediately upon receipt, before confirming delivery. Photographic evidence may be required in the event of a transit damage claim.

Delivery costs are set by the seller at the point of listing based on parcel size. These costs are passed to the buyer and do not form part of the seller fee calculation.

7. Collection Listings

Sellers may list items as "Collection Only", meaning the buyer must collect the item in person from the seller's location rather than receiving it via delivery.

Collection address and privacy: When a seller creates a Collection Only listing, they provide a town/city (shown publicly on the listing) and a full collection address. The full collection address is personal data and is handled in compliance with UK GDPR and Gofted's Privacy Policy. The full collection address is only disclosed to confirmed buyers who have completed payment, within their secure authenticated account area. The collection address is never shown publicly, never included in emails, and never accessible to third parties.

Seller consent: By creating a Collection Only listing, sellers explicitly consent to Gofted disclosing their full collection address to confirmed buyers of that listing. This consent is given at the time of listing and may be withdrawn by deleting the listing before a purchase is made.

Collection deadline: Buyers have 5 days from the date of purchase to collect the item. If the item is not collected within this period, the order will be automatically cancelled and the buyer will receive a full refund. The listing will be reactivated.

Arranging collection: Both parties are strongly encouraged to use Gofted's in-platform messaging to arrange a safe, convenient collection time and location. For high-value items, Gofted recommends meeting in a safe, public place.

Buyer protection: Gofted's standard buyer protection applies to collection orders. Payment is held in escrow and released to the seller only when the buyer confirms collection via their account. Buyers have the same rights to raise a dispute if the item does not match its description.

Gofted's liability: Gofted is not responsible for the outcome of collection arrangements made between buyers and sellers. Gofted does not guarantee the safety of any in-person meeting and recommends both parties exercise their own judgement. Gofted's liability is limited in accordance with Section 12 of these Terms.

8. Returns Policy

Gofted is a peer-to-peer marketplace. Sales are between private individuals and are final by default - there is no automatic right of return.

Returns are not required unless Gofted upholds a dispute (see Section 5). If a dispute is upheld and a return is required, Gofted will determine who bears the return shipping cost based on the circumstances:

Where a return is required, Gofted will coordinate the process and hold funds until the item is confirmed returned to the seller. Refunds are issued once the return is received and inspected.

Gofted's decision on all returns and disputes is final.

9. Cancellations and Refunds

Once a purchase is made, the buyer cannot cancel unless a valid dispute is upheld. Sellers may not cancel an accepted order without agreement from Gofted. Repeated cancellations may result in account suspension.

If a seller fails to ship within 5 business days and does not communicate with the buyer, Gofted reserves the right to cancel the order and issue a full refund to the buyer.

11. Intellectual Property

Gofted and its branding are owned by Orthentik Ltd. By listing items, sellers grant Gofted a non-exclusive licence to display listing content (photos, descriptions) for the purpose of operating the marketplace. This licence ends when the listing is removed.

12. Limitation of Liability

Gofted provides the marketplace platform "as is". To the maximum extent permitted by law:

Nothing in these terms limits our liability for death or personal injury caused by negligence, fraud, or fraudulent misrepresentation, or any other liability that cannot be excluded under English law.

13. Changes to These Terms

We may update these terms from time to time. We will notify registered users by email of material changes. Continued use of Gofted after the effective date constitutes acceptance of the updated terms.

14. Governing Law and Disputes

These terms are governed by the laws of England and Wales. Any disputes arising from these terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
